Terms of Service

1. Parties

These Terms of Service ("Terms") are a legal agreement between you ("you" or "User") and ABIH TECH LLC, a limited liability company organized under the laws of the State of California, operating under the trade name MyCustomAI ("Company," "we," "us," or "our"), located at 2068 Walsh Avenue, Santa Clara, CA 95050.

2. Acceptance

By accessing or using mycustomai.io (the "Site"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site. We may revise these Terms at any time; continued use of the Site after a change constitutes acceptance of the revised Terms.

3. Services described on this Site

The Site describes professional AI consulting and engineering services including feasibility assessments, AI pilots, custom model development, private deployments, training and enablement, and managed AI operations. Descriptions on this Site are informational only and do not constitute a binding offer. Contractual relationships are formed exclusively through fully executed Master Services Agreements ("MSA") and Statements of Work ("SOW") signed by an authorized representative of ABIH TECH LLC.

4. Permitted use

You agree to use the Site only for lawful purposes. You must not:

• Use the Site in any way that violates applicable local, national, or international law.
• Scrape, harvest, or otherwise collect data from the Site through automated means without our prior written consent.
• Transmit any unsolicited commercial communications through Site contact forms.
• Attempt to gain unauthorized access to any part of the Site or its infrastructure.

5. Intellectual property

All content on the Site — including text, graphics, logos, code samples, and architecture diagrams — is owned by ABIH TECH LLC or its licensors and is protected by United States and international copyright law. You may view and print content for personal, non-commercial reference only. You may not reproduce, redistribute, republish, or use any content commercially without our prior written permission.

Trademarks and trade names displayed on the Site, including "MyCustomAI," belong to ABIH TECH LLC. Nothing in these Terms grants you any right to use our trademarks.

6. Customer engagement terms

All paid engagements are governed by a separate MSA and SOW, which will include provisions for confidentiality, data handling, deliverable ownership, payment terms, termination, and liability. In the event of any conflict between these Terms and an executed MSA, the MSA controls.

7. Disclaimer of warranties

The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of liability

To the fullest extent permitted by law, ABIH TECH LLC and its members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use the Site, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claims arising from your use of the Site shall not exceed one hundred US dollars ($100).

9. Indemnification

You agree to indemnify, defend, and hold harmless ABIH TECH LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with your access to or use of the Site or your violation of these Terms.

10. Third-party links

The Site may contain links to third-party websites. These links are provided for convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

11. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions. Any dispute arising under or related to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Santa Clara County, California, and you consent to personal jurisdiction in those courts.
